Quarterly Report - 152 East 11 th Street, Tracy Page 3 <br /> automobile service station on the site and operated the underground storage tanks from <br /> which gasoline leaked into the subsurface <br /> The San Diego Armour Oil Company has been effectively unresponsive to <br /> communications by the State Water Resources Control Board, Division of Clean Water <br /> Programs and the SJCPHS that have requested that company to meet its responsibilities <br /> under the applicable regulations to investigate and remediate the contamination found on <br /> the property and to pay regulatory oversight fees <br /> The Navarras' attorneys have filed a compliant against San Diego Armour Oil and <br /> associated entities with respect to this matter in California Superior Court Further action <br /> related to this litigation is expected when a date for a pre-trial conference has been set by <br /> the Court <br /> Petroleum Underground Storage Tank Cleanup Fund <br /> As the present property owners, the Navarras applied to the Califorrua State Water <br /> Resources Control Board under the Petroleum Underground Storage Tank Cleanup Fund <br /> for a grant to meet the cost of investigating and remediating the site On March 22nd <br /> 1994 the State Water Resources Control Board, Division of Clean Water Programs <br /> notified the Navarras that their application had been reviewed, designated as Claim No <br /> 4928 and assigned to Priority Class B with Rank 458 <br /> On December 29th 1994, the Water Resources Control Board issued an initial Letter of <br /> Commrtrnent for Reimbursement of Costs to the Navarras in the amount of$75,000 00, <br /> which covers a portion of the cost of the site investigation and characterization work that <br /> has been performed at the subject under the direction of the RWQCB and the SJCPHS <br /> During the reporting period, the Navarras initiated the accounting and clerical work <br /> necessary to complete the Standard Form Payment Request documentation required for <br /> compliance with the terms of the Letter of Commitment <br /> WORK M PROGRESS <br /> The following work is in progress <br /> Groundwater Quality Monitoring <br /> A program of groundwater quality monitoring for the 152 East 11 th Street site has been <br /> established according to the Groundwater. Sampling Plan - Property at 152. East 11th. <br /> Stet, Tracy, California that has been approved by the SJCPHS The next sampling round <br /> called for by the plan is to coincide with the annual wet season and is currently scheduled <br /> for February 1995 {Note A corrective action plan for remediation of this site has been <br /> submitted to the SJCPHS for review The plan includes a complete schedule of <br /> groundwater quality monitoring that will be substituted for the current monitoring <br /> schedule when remediation begins ) <br />
