Quarterly Report - 152 East 1 1 th Street, Tracy Page 3 <br /> Search for Dischargers Responsible for Release of Hydrocarbons <br /> • The present owners, Mr and Mrs Albert Navarra and Mr and Mrs Carl Navarra (the <br /> Navarras) purchased the 152 East Street property in December 1978 Since that time no <br /> fuel dispensing or other operations have been conducted on the site that could account for <br /> the contamination that has been found in the subsurface The owners of the site <br /> immediately prior to its purchase by the Navarras were the San Diego Armour Oil <br /> Company and associated parties That company, and other prior owners, operated an <br /> automobile service station on the site and operated the underground storage tanks from <br /> which gasoline leaked into the subsurface <br /> The San Diego Armour Oil Company has been effectively unresponsive to <br /> communications by the State Water Resources Control Board, Division of Clean Water <br /> Programs and the S]CPHS that have requested that company to meet its responsibilities <br /> under the applicable regulations to investigate and remediate the contamination found on <br /> the property and to pay regulatory oversight fees <br /> During the reporting period, the Navarras' attorneys filed a complaint against The San <br /> Diego Armour Oil Company in federal court In response, San Diego Armour Oil claimed <br /> that it is exempt under the petroleum exclusion provisions of the Comprehensive <br /> Response, Compensation and Liabilities Act (CERCLA) from any requirement to <br /> investigate or remediate the contamination found on the subject property <br /> Petroleum Underground Storage Tank Cleanup Fund <br /> As the present property owners the Navarras have apphed to the California State Water <br /> Resources Control Board under the Petroleum Underground Storage Tank Cleanup Fund <br /> for a9 rant to meet the cost of investigating and remediating the site On March 22nd <br /> 1994 the State Water Resources Control Board, Division of Clean Water Programs <br /> notified the Navarras that their application had been reviewed, designated as Claim No <br /> 4928 and assigned to Priority Class B with Rank 458 <br /> i <br /> In response to an inquiry made on May I Oth 1994, State Water Resources Control Board <br /> staff indicated that, while no official estimate could be made, further processing of the <br /> Navarras' claim for compensation under the Petroleum Underground Storage Tani. <br /> Cleanup Fund may be delayed until some time near the end of 1994 <br /> WORK IN PROGRESS <br /> The following work is in progress <br /> Ground%,.ater Qualit,, Monitoring <br /> program of groundv.iter quality monitoring for the 152 East 1 I th Street site has been <br /> established according to the Groundxkater Sam Lwg PI - Pr 1>2 as 1 I th <br />
