I phoned with reference to payment of the above
generator fees which total $47 ,877 .50. As we discussed, SWPC is
appealing the classification of our products as wastes to the State
Department of Health. To that end, we are preparing a report to
the State describing our process.
Per our phone conversation, I understand that your office will
take no action to collect the generator fees for 90 days from the
date of your letter. That would make the Due date for payment
August 3 , 1991. Thank you for this extension of time to pay. If
the situation changes, please let me know. SWPC is willing to make
an earlier payment if need be. SWPC needs a few days notice to
make arrangements if an earlier payment is needed.
As we have agreed with the State Department of. Health, SWPC
will treat these materials as Hazardous Wastes until there is a
determination otherwise. SWPC is doing so under protest. As soon
our report is finished, we will forward a copy to you for your
review.
Thank you for your help in this matter. If you have any
questions or concerns, please feel free to contact me at any time.
Very Truly Yours
-11XA G'
Matthew Y.
