ATTACHMENT 1 <br /> § 25124 HEALTH AND SAFETY :CODE <br /> § 25124. Waste <br /> (a) "Waste" means any discarded material that is not excluded by this chapter, y b regulations <br /> adopted pursuant to this chapter, or by a variance issue pursuant to this chapter. <br /> (b) A discarded material is any material which is any of the following: <br /> (1) Abandoned, as specified in subdivision (c). <br /> (2) Recycled, as specified in subdivision (d). <br /> (3) Considered inherently waste like, as specified in regulations adopted by the department. <br /> (4) Mislabled or' ' 'not adequately labeled,unless the material is correctly labeled or adequately <br /> labeled within 10 days after the material is discovered to be mislabeled or inadequately labeled. <br /> Is packaged in deteriorated or damaged containers,unless the material is contained in sound or <br /> undamaged containers within 96 hours after the containers are discovered to be deteriorated or <br /> damaged. <br /> (c) A material is a waste if it is abandoned by being any of the following: <br /> (1) Disposed of. <br /> (2) Burned or incinerated. <br /> i <br /> (3) Accumulated, stored, or treated, but not recycled, before, or in lieu of, being abandoned by <br /> being disposed of, burned, or incinerated. <br /> (d) A material is a waste if it is recycled, or accumulated, stored, or treated before_ recycling, <br /> except as provided in Section 25143.2. <br /> (Formerly § 25122, added by Stats.1972, c. 1236, p. 2389, § 1.
