Box 239 <br /> Tracy, CA 95378 <br /> NO FURTHER REMEDIAL ACTION REQUIRED,TRIPLE E PRODUCE, TRACY, <br /> SAN JOAQUIN COUNTY <br /> We have reviewed the 15 May 2002 Triple E Produce Facility Groundwater Remediation <br /> Program Site Closure Request(Closure Request) submitted by Condor Earth Technologies, Inc. <br /> on behalf of Triple E Produce (Triple E) for the fresh tomato packing facility at 8690 West Linne <br /> Road in Tracy (site). As detailed in the attached memo, the Closure Request is based on the <br /> remediation work performed at the site and the declining concentrations of chloroform in <br /> groundwater. Chloroform concentrations are expected to continue to decline over time and <br /> eventually meet the water quality objective. Therefore, no further remedial action is required. <br /> However,Triple E must continue to sample downgradient monitoring well MW-7 annually for <br /> chloroform. <br /> Nothing in this determination shall constitute or be construed as a satisfaction or release from <br /> liability for any conditions or claims arising as a result of past, current, or future operations at this <br /> location. Nothing in this determination is intended or shall be construed to limit the rights of any <br /> parties with respect to claims arising out of or relating to deposit or disposal at any other location of <br /> substances removed from the site. <br /> If existing, additional, or previously unidentified chemical constituents at the site cause or threaten <br /> to cause pollution or nuisance or are found to pose a threat to public health or water quality, then 1) <br /> nothing in this determination is intended or shall be construed to limit or preclude the Board or any <br /> other agency from taking any further enforcement action, and 2) this letter does not relieve Triple E <br /> Produce of any responsibilities mandated under the California Health and Safety Code and the <br /> California Water Code.
