DeVries Rd. <br /> Lodi, CA 95240 <br /> Dear Mr. Wallace: <br /> UNDERGROUND STORAGE TANK CLEANUP FUND PROGRAM, NOTICE OF <br /> INELIGIBILITY DETERMINATION: CLAIM NUMBER 1714 <br /> This is to notify you that during the. detailed• review of your <br /> application, it has been determined that your application for the <br /> Hess DuBois Cleanerslocated at 348 W Harding Way, Stockton is <br /> not eligible for reimbursement in the Underground Storage Tank <br /> Cleanup Fund, Therefore, it is being proposed that your claim be <br /> removed from the Priority List based on the following reason(s) : <br /> On December 3, 1990 you submitted a closure plan to San <br /> Joaquin County to remove six underground storage tanks. You <br /> were notified the following day that back fees for tank <br /> permits were overdue which you subsequently paid on December <br /> 20, 1990. <br /> Section 2811 (a) (2) of the Underground Storage Tank <br /> Regulations requires that a claimant to the Fund had and has <br /> obtained any permit or permits required of the claimant <br /> pursuant to Chapter 6.7, Division 20, of the California <br /> Health and Safety Cade, or had filed a substantially <br /> complete application for such permit or permits, not later <br /> than January 1 1990. . . <br /> Although you stated in your application that the tank use <br /> was discontinued in 1960, this did not relieve you- of the <br /> requirement to obtain permits for them. You have violated <br /> the California Health and Safety Code. This precludes you <br /> from being an eligible claimant to the Fund. <br /> This letter is considered a Final Staff Decision. If you are not <br /> in agreement with this decision, you may request review of the <br /> staff decision by the Chief of the Division within sixty (60) <br /> calendar days of receipt of this letter as provided in Article 5 <br /> of the Cleanup Fund Regulations. <br />
