The appeal and request is based on the following: <br /> 1. Statement Describing How the Estate of Peter J Wallace, Sr. Has Been Damaged By The <br /> Prior Staff Decision: <br /> i <br /> _,The.EAate of.Peter J _Wallace,,Sr..,,has been,damaged by_the Prior�StaffDecision.because'l <br /> the USTCF found costs for directed investigation of the former underground storage tanks <br /> to be ineligible for reimbursement. A direct financial hardship for costs associated with the <br /> mitigation of contamination on the site, without the benefit of cost reimbursement, will <br /> occur. The subject property is the Estate's only remaining tangible asset. <br /> 2. Description Of Remedy Or Outcome Desired: <br /> The Estate would request that the investigative costs directed by the San Joaquin County <br /> Environmental Health D"epartment (SJCEHD) and previously submitted to the USTCF be <br /> found eligible for immediate reimbursement.Additionally,the Estate requests that all future <br /> costs associated with the stoddard solvent investigation and/or remediation under Claim No. <br /> 1713 be deemed eligible for cost recovery. <br />
