0 • <br /> 5. SK completed its cleaning of all three basins. SK, however, left clean absorbents at <br /> the bottom of all three basins due to the apparent initial desorption of oily liquid from the <br /> bottom of the basins up onto the surface of the basin. <br /> 6. TRE reviewed the manifest and the material profile. The manifest lists two (2) 55- <br /> gallon drums of CA 223, Texas waste code OUTS 6091, which was transported by <br /> Safety Kleen to Safety Kleen's facility located in Denton, Texas (see copy of the manifest <br /> enclosed in attachment B). <br /> 7. Mr. Calcaterra signed the manifest and the material profile prior to the off-site <br /> transportation of the two drums. Copies of the manifests, material profile and SK's <br /> indemnification certification were presented to Mr. Calcaterra and per Mr. Calcaterra's <br /> request, these documents were later on the same day given to Chris Nielsen of Mayall <br /> Hurley Law Firm in Stockton, CA. <br /> 8. As was required by our scope of work, TRE conducted inspection all three basins (N <br /> 37 57 416, W 121 17 743) in order to conduct a preliminary visual assessment of the <br /> condition of the concrete liner. The flow of the material in these basins appear to be <br /> from the right to left as the depth of the basins are: 31.2" (first basin), 21" (second <br /> basin), and 20" (third basin), hence suggesting a pressure gradient induced fluid flow <br /> from right (East) to left (West). <br /> 9. TRE observed that the first two basins appeared to have some pitting and damage at <br /> their bottom layers. The third basin was observed to have significant pitting and <br /> damage on its bottom layer. TRE observed chunks of broken up and damaged concrete <br /> that were removed with the oily sludge during SK's cleaning of the third basin. Exposed <br /> soil or soft sediments (which appeared to have been impacted by the oily liquid) beneath <br /> the third concrete basin was observed when checked with hand by TRE. <br /> 10. TRE also observed an outflow pipe in the third basin, which appeared to be situated <br /> at a low point in the third basin, suggesting that the concrete basin was designed as a <br /> simple gravity induced concrete chamber oil/water clarifier. <br /> 11. At the request of Mr. Calcaterra, TRE returned back to the site the next day <br /> (11/24/04) and visually observed the basin for any evidence of desorbed oil. TRE did <br /> not observe significant amount of oily liquid that were absorbed by the absorbent pads. <br /> The absorbent pads were left in the cleaned and pumped out basins. <br /> In view of the above, in order to ensure that our client is complying with the <br /> California Health and Safety Code (CAHSC) Section 25507 and other applicable section <br /> of the CAHSC, the foregoing notification is hereby made to your attention. We are also <br /> copying the State OES, San Joaquin County Environmental Health Department, <br /> California Department of Toxic Substances Control (DTSC) and the Central Valley <br /> Regional Water Quality Control Board (CVRWQCB). <br /> 2 <br />
