Further,to the extent that Donor has provided to Donee- <br /> information and documentation relating to the environmeritai condition of the Property;'Donor <br /> makes no representations or'iwarranties wit1i respect to the acoarac�y or completeness, <br /> methodology of preparation;or othez-wise concerning the contents of such documents and/or <br /> reports. Except for those express representations and warranties set forth in Paragraph 18, Donee <br /> acknowledges that it is not acting on nor relying on any other representations of Donor,if any <br /> 1 other such representations of warranties were in fact made. <br /> 18. Donors' Express Representations: Donors make the following express representations <br /> regarding the Property: <br /> a. To Donor's actual knowledge, seven underground storage tanks known by Donar <br /> . to have existed on the Property and confirmed through assessment procedures <br /> i <br /> were removed pursuant to permits obtained:from.the San Joaquin County Public <br /> Health Services, Environmental health Division in or about 1986 and 1992. <br /> b. In or about July 1995,Chase Chevrolet received a Letter of Commitment from the <br /> USTCP to seek reimbursement for costs of assessment and remediation of the <br /> contamination associated with the underground storage tank. The USTCF Claim <br /> ` number is 1657.. <br /> c. Assessment of the contamination associated with the underground storage tanks <br /> t . bornmenced in or about September'1990 and excavation.of some of the <br /> contaminated soils took place in March 2001. <br /> i d. To.Donor's actual knowledge,copies of docUrrients prepared by Advanced <br /> ' GeoEnvironmerttal and submitted to the San'Joaquin County Emvironx' ental <br /> Health Division and/or USTCF have been twined aver to Donee.prior to the <br /> execution of this Agreement. A list of documents provided to'Donor is attached <br /> as Exhibit A and incorporated by this reference. <br /> e• I:n.regards to documentation not generated by Advanced GeoEuvironm.ental, <br /> Donor agrees to direct Advanced.GeoEnvironnlental to obtain,copies of such <br /> documents that:' presently located in the files of the San Joaquin County <br /> Euv>ronmental Health Division and which Advanced GeoEnviroiimental has <br /> access to relating to the Property and provide,tliem to Donee Prior to the <br /> execution of this Agreement, as identified in Exhibit A. <br /> f. To Donor's actual knowledge, other than matters re <br /> lat7F1 to the contamination <br /> associated with the underground storage ta??.ks and the involvement and oversight <br /> of San Joaquin County Public Health Services Envirortmental.Health Division and <br /> the USTC1~, there are no legal Fictions, suits, or other legal or administrative <br /> ' proceedings pending or threatened against or affecting the Property except San <br /> Joaquin Superior4 Court Case No. 183671,Robert A, Chase vs. William K Chase, <br /> a receiverskup action which will be resolved upon close of escrow. <br /> Page 8 <br /> I I . <br />
