aa. Any c1a'4' for bodily injury or human condition or ailment;
<br /> bb. Any claim related to any contract to which the Auto Investment Parties or the
<br /> Chase Parties are a party, except as expressly provided herein;
<br /> CC. Any action unrelated to the contaminated or allegedly contaminated condition of
<br /> the Property.
<br /> Buyer acknowledges that it is purchasing real property-the physical condition of which is
<br /> contaminated, and has been advised by Iegal counsel and is familiar with the provisions of
<br /> California Civil Code Section.,1542 and, subject to the Exclusions, Buyer expressly waives the
<br /> rights and benefits.of Section 1542 of the California Civil Code, which provides as follows,relating
<br /> solely-to the contaminated nature of the Property:
<br /> "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE
<br /> CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE
<br /> TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM,MUST HAVE
<br /> MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR."

<br /> 15. Buver's Indemnification: From and after Closing, Buyer on behalf of itself and its
<br /> successors and assigns shall, to the maximum extent permitted by law,'save, defend, indemnify
<br /> and hold harmless (collectively"to Indemnify") each and every 3Auto Investment Parties(defined
<br /> above) and each and every Chase Chevrolet Parties (defined above),and their respective heirs,
<br /> successors, personal representatives and assigns, of and from any and all demands, claims, legal
<br /> proceedings,-administrative.proceedings, governmental proceedings,suits, losses, liabilities,
<br /> damages, interest, penalties, fines,judgments, legal fees, response costs, costs or expenses of
<br /> whatever kind.or:nature, in law or equity, known or unknown, whether direct.or..indirect,
<br /> foreseen or unforeseen; concerning the contaminated or allegedly contaminatedphysical
<br /> condition of the Property and contamination or alleged contamination emanating or'alleged to
<br /> have emanated from the Property, subject to the Exclusions, including and/or alleged to be
<br /> caused by or related to the following:
<br /> a. the Auto Investment Parties and/or Chase Chevrolet Parties ownership,use,
<br /> maintenance, and/or operation of the Property which may have or actually
<br /> resulted in the contaminated physical condition of the soils and/or groundwater;
<br /> b. the physical condition, status, quality, nature, or state of the Property related to
<br /> any environmental contamination that may exist in and/or on the Property and/or
<br /> emanate from the Property;
<br /> C. the presence or alleged presence of any and all substances that are and/or may be
<br /> considered toxic, hazardous, a contaminant, a waste and/or a pollutant in, on,
<br /> under, or about the Property and/or emanating from the Property, including but
