Assessment of the contamination associated with the underground storage tank <br /> commenced in or about September 1990 and remediation of the contamination <br /> associated with the underground storage tank commenced in or about July 1999 <br /> and is continuing. <br /> d. To Seller's actual knowledge, copies of documents prepared by Advanced <br /> GeoEnvironmental and submitted to the San Joaquin County Environmental <br /> Health Division and/or USTCF have been turned over to Buyer prior to the <br /> execution of this Agreement. A list of documents provided to Seller is attached as <br /> Exhibit A and incorporated by this reference. <br /> e. In regards to documentation not generated by Advanced GeoEnvironmental, <br /> Seller agrees to direct Advanced GeoEnvironmental to obtain copies of such <br /> documents that are presently located in the files of the San Joaquin County <br /> Environmental Health Division and which Advanced GeoEnvironmental has <br /> access to relating to the Property and provide them to Buyer prior to the execution <br /> :-of this Agreement, as identified in Exhibit A. <br /> f In.July 1999, Advanced GeoEnvironmental began installation of a soil vapor <br /> `'ektraction/air sparging system on the Property and said system became <br /> operational in November 1999 and is currently in operation. Buyer acknowledges <br /> drat said system is owned by Advanced GeoEnvironmental and is'being rented to <br /> SeIler pursuant to an agreement entered into.between Seller'and Advance <br /> GeoEnvironmental in which it was agreed that.the system.would be operational <br /> for.24 months subject to the approval of the.USTCF. Buyer agrees to the <br /> assignment of this agreement and to be bound by its terms. Seller agrees to direct <br /> Advanced GeoEnvironmental to provide Buyer with copies of all documentation <br /> concerning the technical specifications, installation, maintenance, operation <br /> and/or modification of said system prior to the close of escrow. <br /> g. To Seller's actual knowledge, other than matters relating to the contamination <br /> associated with the underground storage tank and the involvement and oversight <br /> of San Joaquin County Public Health Services Environmental Health Division and <br /> the USTCF, there are no legal actions, suits, or other legal or administrative <br /> proceedings pending or threatened against or affecting the Property except San <br /> Joaquin Superior Court Case No. 183671, Robert A. Chase vs. William K. Chase, <br /> a receivership action which will be resolved upon close of escrow. <br /> h. The Seller is the owner of the Property and has marketable and insurable fee <br /> simple title to the Property, appurtenances, personalty and Improvements, free of <br /> restrictions, liens and other encumbrances, leases, subleases or other rights to <br /> possession or occupancy,recorded or unrecorded, except for the lease identified <br /> in section I(c), above. Seller shall,prior to the execution of this Agreement, <br /> provide to Buyer a copy of the lease with Charter Way Tow. <br /> Page 9 <br />
