Van Buren SITE CODE: 2511 <br /> San Joaquin County Public Health Service, Environmental Health <br /> Division (PHS/EHD) has completed our review of the "First Quarter <br /> 1992 Groundwater Monitoring Report" (QM) prepared by Resna. <br /> The QM Report is minimal compliance. In correspondence from this <br /> office dated May 23, 1991, Chase Chevrolet and the principals of <br /> Auto Investment Company were directed to prepare a workplan to <br /> preform the continued site characterization. A copy of this <br /> directive is enclosed. <br /> To date, PHS/EHD has received no indication from the responsible <br /> parties (RPs) as to when or if compliance with the directive will <br /> be achieved. <br /> Chase Chevrolet, the principals of Auto Investment Company, and <br /> their respective legal advisors are hereby notified that unless a <br /> workplan for continued "Site Characterization" is submitted to <br /> PHS/EHD and the Central Valley Regional Water Quality Control <br /> Board by August 17, 1992, PHS/EHD will declare these sites and <br /> their RPs recalcitrant. <br /> Should PHS/EHD find it necessary to make such a declaration, the <br /> Funding eligibility of both sites will be threatened. <br /> The hesitation for continued "Site Characterization" can only be <br /> interpreted as recalcitory action. Continuation of this lack of <br /> responsiveness will not be tolerated. <br /> Your immediate response to this current directive is requested <br /> within 5 calendar days from the date of this letter. Your <br /> response shall include a time schedule for the August 17 <br /> workplan, the submittal of the completed "Problem Assessment <br /> Report" (PAR) within the following 6 to 8 weeks, and all <br /> subsequent QM reports.
