The February 16, 1995 invitation for bid was reviewed as <br /> a workplan by PHS/EHD staff on February 23, 1995. PHSIEHD comments on the workplan <br /> were communicated during a telephone call to Mr. Setness on February 23, 1995. Mr. <br /> Setness submitted a response to comment$ letter to PHS(EHD dated February 23, 1995. <br /> PHS/EHD has determined that the February 2, 1995 invitation for bid combined with the <br /> February 23, 1995 response to comments letter complies with the soil and water <br /> investigation phase workplan described in the California Code of Regulations Chapter 16 <br /> Section 2725 (a) which states that the "Soil and Water Investigation phase includes the <br /> collection and analysis of data necessary to assess the nature and vertical and lateral extent <br /> of the release to determine a cost-effective method of cleanup_ <br /> The March 15, 1995 agreed upon implementation date was not enforced by PHS/EHD due <br /> to numerous communications with Mr. Setness requesting time extensions to Complete the <br /> three bid process with the State Water Resources Control Board. <br /> At this time PHS/EHD has not received the first quarter 1995 quarterly report.. Mr- Setness <br /> has communicated that the report will be submitted to this office no later than May 12, <br /> 1995. <br /> Exhibit I <br />
