y " I N D E M N I T Y MOHAMMAD JAMEEL is aware that portions of the Partnership prop- erty located at 521 N . Cherokee Lane , Lodi , California have been polluted by the leakage of gasoline and is being investigated by the State Water Resources Control Board. Further MOHAMMAD JAMEEL is aware that SALEEM KHAN signed an Indemnity Agreement with CARL YEARING sellers of the subject property, agreeing to indemnify and hold CARL YEARING harm .ss in regards to the polluted property. With said knowledge and disclosure MOHAMMAD JAMEEL agrees as follows : 1 . To indemnify, defend , and hold SALEEM KHAN harmless from all claims relating thereto , including, but not limited to claims for personal injuries , property damages , civil and criminal penalties , and clean-up expenses . 2. MOHAMMAD JAMEEL hereby accepts and subject real property "As Is" in its present condition, and releases and forever discharges SALEEM KHAN from all claims and liability that SALEEM KHAN may have to MOHAMMAD JAMEEL on account of the condition of said property, including , but not limited to liabilities or claims relating to civil or criminal penalties imposed on MOHAMMAD JAMEEL because of the aforesaid pollution; pollution clean-up expenses which MOHAMMAD JAMEEL shall incur, and; liabilities for personal injuries or property damages caused by said pollution whether past , present , or future . Purchaser hereby waives his rights under section 1542 of the California Civil Code , which Section provides as follows : "A general release does not extend to claims which creditor does not know or suspect to exist in his favor at the time of executing the release , which , if know by him, must have materially affected his settlement with the debtor. " The indemnification and release provisions of this Agreement shall inure to the benefit of and bind the heirs , successors , and assigns of the parties .
