Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> Immediately stop recycling metal fines, make a hazardous waste determination for any metal fines generated,and <br /> manage it according to Title 22 hazardous waste regulations. Particles 100 microns or smaller must be handled as <br /> hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and supporting <br /> documentation explaining how this waste will be managed. <br /> This is a minor violation. <br /> 113 HSC 25160.2(b)(3)Failed to keep copies of consolidated manifesting receipts for three years. <br /> Copies of hazardous waste disposal records for used oil from the forklifts were not found on site.According to the <br /> Supervisor,Andrew Moore,Watts services the forklifts and takes the used oil back with them.If the used oil is not <br /> being disposed of on a uniform manifest or a consolidated manifest,the following documentation needs to be kept <br /> for the facility to show that the repair business is following California Health and Safety Code Section 25250.12 <br /> under Article 13 of Management of Used Oil: <br /> -The amount of used oil generated showing that no more than 55 gallons is transferred in the vehicle at any one time. <br /> -The address information on where used oil is being transported to. <br /> -The date the used oil is generated. <br /> Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts <br /> used in a consolidated manifesting procedure on site for three years and have them readily available for review. <br /> Immediately start maintaining all required records. <br /> This is a minor violation. <br /> 303 CCR 66262.34(d)(2)Failed to maintain all communication or alarm systems,spill control,or decontamination <br /> equipment. <br /> Used oil was observed in the secondary containment near the used oil tank. <br /> All facility communications or alarm systems,fire protection equipment,spill control equipment,and decontamination <br /> equipment,where required,shall be tested and maintained as necessary to assure its proper operation in time of <br /> emergency. Immediately clean the secondary containment and begin this practice. <br /> This is a minor violation. <br /> 406 CCR 66261.7 Contaminated container not marked with date emptied or managed within one year of being emptied. <br /> Near the shop area,three 55 gallon steel drums were observed without an empty label. <br /> Containers larger than five gallons that previously held a hazardous material shall be marked with the date they were <br /> emptied and managed within one year of being emptied.
