Caspe, Esquire 2035 North Pacific Avenue Santa Cruz, California 95060 Subject: Former Stefano's Gasoline Station 1419 East Charter Way Stockton, California 95205 The San Joaquin County Environmental Health Department (EHD) has reviewed the letter dated September 2, 2008, from Mr. Dennis G. Caspe, Attorney at Law concerning the Estate of Joseph G. Gardella, Senior. In the letter, Mr. Caspe stated that all rights to the property at 1419 East Charter Way, Stockton, California, including legal obligations for the investigation and mitigation of petroleum hydrocarbon contamination associated with the farmer underground storage system, have been transferred to Sarbjit Singh Sarao. Mr. Caspe requested notification if the EHD believed that the Estate of Joseph G. Gardella still had responsibility for current and future investigation and cleanup of chemicals of concern at the above-referenced site. On August 1, 2007, the EHD sent Mr. Sarbjit Singh Sarao a "Notice of Responsibility" letter. This is basically the same letter that the EHD sent to Ms. Winifred Alexander and Mr. John Leman on August 12, 1994; Trust of Mary Gardella, Winifred Alexander, Trustee, on July 31, 1996; and Estate of Joe Gardella, John Lehman, Administrator, in care of Mr. Dennis Caspe, Esq. on July 31, 1996. The California Code of Regulations, (Title 23), Division 3, Chapter 16, Article 11, Section 2720 defines a "responsible party" as one or more of the following: (1) Any person who owns or operates an underground storage tank used for the storage of any hazardous substance; (2) In the case of any underground storage tank no longer in use, any person who owned or operated the underground storage tank immediately before the discontinuation of its use;
