Mr. Phillip Fitzwater - 3 - 18 August 2005 <br /> Institutional controls such as deed restrictions limiting future land uses to industrial uses are used when <br /> necessary to prevent residential development on properties that have not been cleaned up to the more <br /> stringent standards of residential uses. Deed restrictions, when necessary, are typically put in place <br /> following the completion of cleanup. <br /> In regards to your request that Oxychem set aside money to pro-fund the remediation project, Regional <br /> Board staff is not aware of information that would warrant such action at this time. OxyChem has a long <br /> history of following through with its commitments to remediation. <br /> OxyChem will be providing an annual review of remediation performance including gauging <br /> performance objectives against thresholds that would trigger alternative remediation. An additional five- <br /> year review will not be required. <br /> Geomatrix Consultants provided a Phytoremediation Work Plan in November 2001, which outlined the <br /> initial planting schedule and soil sampling plan. The October 2004 Groundwater Cleanup and <br /> Contingency Plan updates the Phytoremediation Work Plan with inspection, maintenance and <br /> operational specifics. A groundwater sampling plan is prescribed in Monitoring and Reporting Program <br /> No. R5-2002-0831 issued by the Executive Officer of the Regional Board. The soil and groundwater <br /> sampling plans may be updated periodically as remediation proceeds,but in essence will continue to <br /> guide soil and groundwater sampling for the life of the remediation project. OxyChem will be required <br /> to destroy all monitoring wells to the satisfaction of San Joaquin County Environmental Health <br /> Department before the Regional Board will consider granting the site No Further Action status. <br /> Regional Board staff appreciate Iris Environmental's comments and concern for protecting residents of <br /> the Bridgeport Trails development. Concentrations of constituents in groundwater beneath the <br /> Bridgeport Trails development have decreased significantly since OxyChem's 2001 soil remediation and <br /> concerns about exposure are correspondingly reduced.
