(OxyChem/Simplot) <br /> facility at 1904 W. Charter Way in Stockton prepared by Geomatrix Consultants, Inc. The <br /> feasibility study proposes a remediation method that requires OxyChem/Simplot to have control <br /> of the property for an extended time that, as discussed below,was not possible until this summer. <br /> The selected remedial alternatives will require intensive use of the property for an extended <br /> period of time (i.e., at least two years for the demonstration project and greater than 5 years if the <br /> alternative is effective). Other remedial alternatives for soil will also require full, unimpeded <br /> access to the site, albeit for a shorter period of time. Currently, Leo and Eva Volpi, the site <br /> property owners, lease the site to a truck trailer and pallet storage operation. OxyChem/Simplot, <br /> the principally responsible party, does not have full access to the site at this time and is, <br /> therefore, unable to implement the proposed or any other soil remediation program. <br /> It is our understanding that OxyChem/Simplot and the current owner have attempted to negotiate <br /> site access through a long term lease or sale of the property. So far, these negotiations have been <br /> unsuccessful. We further understand that the lease with the current tenant expires this summer. <br /> The site property owners, as a potentially responsible party,need to ensure that <br /> OxyChem/Simplot has the property access needed to implement the proposed(or another) soil <br /> remediation program in order to avoid having to share responsibility for the soil cleanup itself. <br /> We will be available to meet with you as necessary to further discuss this matter. <br /> California Environmental Protection Agency <br /> 0 Recycled Paper <br /> The energy challenge facing California is real.
