(GSHI), a subsidiary of <br /> Occidental Chemical Corporation (OCC), Geomatrix Consultants, Inc. (Geomatrix) submitted <br /> the"Work Plan for Additional Groundwater Investigation" for the subject property. In a July <br /> 21, 1998, letter to GSHI, the California Regional Water Quality Control Board(RWQCB) <br /> approved the Work Plan. <br /> Since that time, Geomatrix and OCC's legal counsel (Landels, Ripley& Diamond) have been <br /> working on access agreements with owners and tenants of properties that would be required to <br /> conduct the additional groundwater investigation described in the Work Plan. One of the <br /> necessary access agreements has been successfully negotiated. However, the remaining two <br /> access agreements have not been completed with the property owners. Thomas D. Trapp of <br /> Landels, Ripley & Diamond has transmitted proposed access agreements to the two remaining <br /> property owners, and we are awaiting their response. <br /> Until the access agreements are successfully negotiated, Geomatrix is unable to initiate the <br /> additional groundwater investigation described in the Work Plan.
