CHARTER, STOCKTON <br /> Thank you for submitting the latest quarterly report for the underground tank investigation at <br /> the former PureGro facility on Charter Way. In addition to petroleum products, the <br /> analytical results show that pesticides are present in the southern monitoring wells. 1,2- <br /> Dichloropropane was found at 1,000 ppb, while lesser amounts of four other halocarbons <br /> were also detected. <br /> Our files show that Oxychem used the southern portion of the property for a washrack and <br /> evaporation ditch in the 1970's. When PureGro operated the site, the southern portion <br /> contained a tank farm (fertilizer and Telone) and a washrack. PureGro also installed and ' <br /> sampled at least two monitoring wells in 1985. <br /> Because the 1,2-dichloropropane was found in groundwater at 200 times the California <br /> Primary MCL, and because of concerns about past practices at the site, Simplot and/or <br /> Oxychem and/or Unocal are hereby requested to investigate the source and extent of pesticide <br /> and nitrate contamination at the facility. We understand that there are some legal issues to <br /> be resolved as to the responsible party(s). Therefore, we will not ask for a workplan at this <br /> time. Instead, we ask that the following questions be answered: <br /> 1. If the Board were to issue an enforcement order for investigation and cleanup at this site, <br /> we would name all former operators and the landowner as responsible parties. <br /> However, we prefer our initial work to be on a cooperative basis, and therefore we will <br /> give the legal departments of Simplot, Oxychem, and Unocal some time to determine <br /> who the responsible party(s) will be. Who will be designated as the lead person to <br /> oversee the cleanup for the three companies? <br /> 2. Per Section 13304 of the Water Code, the Regional Board is authorized to recover <br /> reasonable expenses incurred during the oversight of the cleanup of discharges which <br /> have affected water quality. Cost recovery will be implemented at this site; please <br /> supply the name and address to which bills should be sent. <br /> 3. What do you consider to be a reasonable timeline for hiring a consultant and preparing a <br /> workplan for further investigation of the pesticide and nitrate contamination at the <br /> facility? <br />
