R5-2017-0817, FORMER HELENA <br /> CHEMICAL FACILITY, 2245 WEST CHARTER WAY, STOCKTON, SAN JOAQUIN COUNTY <br /> On 26 October 2017, California Regional Water Quality Control Board, Central Valley Region <br /> (Central Valley Water Board) staff transmitted a draft Monitoring and Reporting Program (MRP) <br /> for the Former Helena Chemical Facility. On 10 April 2017, your consultant, Mr. John Lane of <br /> Condor Earth, provided comments on the draft MRP, recommending the following: <br /> • Revising the statement"The Discharger operated an agricultural chemical storage and <br /> distribution facility at 2245 Charter Way, Stockton, San Joaquin County(Site)"to state that <br /> "The Discharger owns real property at 2245 Charter Way, Stockton, San Joaquin County <br /> (Site) which in the past has been leased to and operated by tenants who operated an <br /> agricultural chemical storage and distribution facility." <br /> • Revising the statement "The Discharger is responsible for the discharge because the <br /> Discharger operated the agricultural chemical storage and distribution business that <br /> released the pollutants" to state that "The Discharger is responsible for the discharge <br /> because the Discharger owns real property at which tenants operated the agricultural <br /> chemical storage and distribution business that released the pollutants." <br /> Central Valley Water Board staff revised the MRP as recommended.
