Peter Wallace -3- <br /> Claim No. 1714 <br /> As a result of this recalculation,I have determined that the total overpayment from the Fund is <br /> $42,043.34. The Fund will not reimburse any future costs until the overpayment has been offset. <br /> Decision <br /> This represents a revised FDD. The State Water Board will continue to review your pending petition <br /> regarding the parts of the July 19, 2004, FDD that were not superseded by this revised FDD. If you <br /> disagree with this revised FDD,you may file a new petition for review by the State Water Board that <br /> will be reviewed in conjunction with the State Water Board's review of the remaining issues raised by <br /> your initial petition. If you do not file a new petition in response to this revised FDD, the <br /> determination made in this revised FDD will become final, and the State Water Board will not consider <br /> this determination when reviewing the initial petition. <br /> The new petition must be received by the State Water Board within 30 days from the date of this <br /> revised FDD, as provided in Title 23, Chapter 18, Article 5 of the California Code of Regulations. <br /> Your new petition must be sent to Mr. Arthur Baggett,Jr., Chairman of the State Water Board, with <br /> copies to Mr. Craig M. Wilson, Chief Counsel, and Ms. Barbara L. Evoy, Chief of the Division of <br /> Financial Assistance, at the following address: <br /> State Water Resources Control Board <br /> P.O. Box 100 <br /> Sacramento, CA 95812-0100 <br /> The new petition to the State Water Board must include, at a minimum: (1) the name and address of <br /> the petitioner; (2) a copy of the revised FDD that the State Water Board is requested to review; (3) an <br /> explanation of why the petitioner believes the revised FDD is erroneous, inappropriate, or improper; <br /> (4) a statement describing how the petitioner is damaged by the revised FDD; and (5) a description of <br /> the remedy or outcome desired.
