Wallace, Sr. <br /> Former Hess Dubois Cleaners <br /> 348 West Harding Way, Stockton, California <br /> Dear Mr. Patton: <br /> In accordance with a letter from the State Water Resources Control Board - Division of Financial <br /> Assistance (Underground Storage Tank Cleanup Fund), dated 14 May 2004, the Estate of Peter J. <br /> Wallace, Sr. (The Estate), is requesting a review of the ineligibility determination for Claim No. <br /> 1714 for the site located at 348 West Harding Way, Stockton, California. <br /> The Estate, property owner, hereby appeals the SWRCB Staff Decision which found their USTCF <br /> claim reimbursement and placement on the priority list(claimant status)and request your review of <br /> the Staff Decision. The appeal and request is based on the following: <br /> 1. Statement Describing How the Estate of Peter J. Wallace, Sr. Has Been Damaged By The <br /> Prior Staff Decision: <br /> The Estate of Peter J. Wallace, Sr., has been damaged by the Prior Staff Decision because <br /> the USTCF found costs for directed investigation of the former underground storage tanks <br /> to be ineligible for reimbursement. A direct financial hardship for costs associated with the <br /> mitigation of contamination on the site, without the benefit of cost reimbursement, will <br /> occur. The subject property is the Estate's only remaining tangible asset. <br /> 2. Description Of Remedy Or Outcome Desired: <br /> The Estate would request that the investigative costs directed by the San Joaquin County <br /> Environmental Health Department (SJCEHD) and previously submitted to the USTCF be <br /> found eligible for immediate reimbursement.Additionally,the Estate requests that all future <br /> costs associated with the stoddard solvent investigation and/or remediation under Claim No. <br /> 1713 be deemed eligible for cost recovery. <br />
