DeMera <br /> Mullen, Sullivan and Newton <br /> Attorneys at Law <br /> Post Office Box 560 <br /> Lodi, CA 95241-0560 <br /> GEWEKE LAND AND DEVELOPMENT, LODI, SAN JOAQUIN COUNTY <br /> We have received your letter dated 24 August 1993, regarding your plan to bioremediate <br /> hydrocarbon-contaminated soil by injecting soil bacteria into the ground water via monitoring <br /> wells. <br /> The actions proposed are regulated under the Porter-Cologne Water Quality Control Act. <br /> The discharge is a waste discharge. The California Water Code requires any person <br /> proposing to discharge waste to file with the Regional Board a report of the discharge <br /> containing such information as the Board requires. Each report shall be accompanied by a <br /> filing fee. The Water Code further provides that no person shall initiate any new discharge <br /> of waste prior to the issuance of waste discharge requirements, the expiration of 120 days <br /> after filing a completed Report of Waste Discharge, or the Regional Board's waiver. <br /> whichever occurs first. <br /> Enclosed are instructions, a blank Report of Waste Discharge form, and additional <br /> information requirements. The report must provide more detail as to the concentrations of <br /> all chemical constituents involved in the the inoculum and any other additives (e.g. <br /> nutrients). An explanation of how the process will be operated, controlled, and monitored <br /> must also be provided. Upon review of the information, we will determine the appropriate <br /> annual filing fee to be submitted. The report cannot be considered complete until the fee is <br /> submitted and all provisions of the California Environmental Quality Act are met. <br /> I understand that the Final Remediation Plan, dated 30 July 1993 was submitted to Elizabeth <br /> Thayer, of our office, and is undergoing review. Her comments on the plan are <br /> forthcoming. Upon approval of the Plan, and the submittal of a complete Report of Waste <br /> Discharge, we will draft Waste Discharge Requirements for the discharge. <br />
