San Joaquin County Department of Public Health Services staf* concurs <br /> that this enforcement action is necessary. <br /> 9. The site is located in the rortharn part of San Joaquin County and <br /> overlies the San Joaquin Valley Ground Water Basin, the beneficial uses <br /> of wh;ch include: <br /> a. Municipal and domestic supply, <br /> b.- Agricultural supply, <br /> c. Industrial service supply, and <br /> d. Industrial process supply. <br /> 10. The Dischargers have caused or permitted wastes to be discharged into <br /> the waters of the state and is creating or is threatening to create a <br /> condition of nuisance or pollution. <br /> 11. In conducting an investigation of the quality of any waters of the state <br /> within its region, the Board may require that any person discharging or <br /> Proposing to discharge waste within its region or any citizen or <br /> domiciliary, or political agency or entity of this state discharging or <br /> proposing to discharge waste outside its region that could affect the <br /> quality of the waters within its region shall furnish, ander penalty of <br /> perjury, those technical or monitoring program reports as the Board may <br /> specify. The burden, including costs, of those reports shall bear a <br /> -- reasonable relationship to the need for the report and the benefits to <br /> be obtained from the reports. (California Water Code, Section 13267) <br /> _ 12. Any person who has discharged or discharges wastes into the waters of <br /> the state in violation of any waste discharge requirement or other order <br /> or prohibition issued by a regional board or the state board, or who has <br /> caused or permitted, causes or permits, or threatens to cause or permit <br /> any waste to be discharged or deposited where it is, or probably will <br /> be, discharged t3 the weters of the state and creates, or threatens to <br /> cremate a condition of pollution or nuisance, shall upon order of the <br /> regional board clean up such waste or abate the effects thereof or, in <br /> the case of threatened pollution or nuisance, take other necessary <br /> remedial action. (California Water Code, Section 13304) <br /> 13. This enforcement action is exempt from the provisions of the California <br /> Environmental quality Act (Public Resources Code, Section 21000 et seq.) <br /> in accordance with- Section 15321, (a) (2), Title 14, California Code of <br /> Regulations. <br /> i4 IT .IS HEREBY ORDERED that, Pursuant to sections 13267 and 13304 of the <br /> California Water Code, the Dischargers shall: <br /> 1, By 23 March 1990 submit to the Board a work plan for installing ground <br /> water monitoring wells sufficient to determine the quality of ground <br />
