CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> CLEANUP AND ABATEMENT ORDER NO. 93-XXX <br /> FOR <br /> GEWEKE LAND DEVELOPMENT & MARKETING <br /> 16 SOUTH CHEROKEE LANE, LODI <br /> SAN JOAQUIN COUNTY <br /> The California Regional Water Quality Control Board, Central Valley Region, <br /> (hereafter Board) finds that: . <br /> 1 . The property at 16 South Cherokee Lane in Lodi is owned by Geweke Land <br /> Development & Marketing, a general partnership. The partners, hereafter <br /> referred to as the Dischargers, are Daryl Geweke, Larry Geweke, and Mark <br /> Geweke. This site was formerly operated as a gasoline service station. - <br /> The site location is shown in Figure A and a site schematic is shown in <br /> Figure B. <br /> 2. In 1985, one monitoring well was installed and ground water contamination <br /> was detected. By 1986, a total of five wells had been installed but <br /> additional investigation was necessary to define the contamination. By Q <br /> 1989,. no additional wells had been installed and reports were incomplete. <br /> 3. Cleanup and Abatement Order No. 90-702, issued by the Executive Officer on <br /> 5 March 1990, ordered the Dischargers to submit quarterly reports, submit <br /> a work plan by 23 March 1990 to install sufficient monitoring wells to <br /> define the extent of contamination, implement the work plan no later than <br /> 13 April 1990, submit a "problem assessment report" by 25 May 1990, submit <br /> a "final remedial plan" by 29 June 1990, and implement the "final. remedial <br /> plan" no later than 24 August 1990. <br /> 4. Quarterly reports were not submitted from April 1990 to October 1991. The <br /> Executive Officer issued Monitoring and Reporting Program No. 90-702 (MRP) <br /> on 18 December 1991 containing a well sampling and analysis schedule. <br /> Quarterly reports submitted since the MRP was issued have not included <br /> analytical results for all constituents required. <br /> 5. The work plan was submitted 23 March 1990 and four additional wells were <br /> installed in July 1990. The new wells were contaminated and so failed to <br /> define the extent of contamination. Eventually five more wells were <br /> installed in May 1991, the extent of ground water contamination was <br /> defined, and the Problem Assessment Report was submitted on 31 July 1991 <br /> (due 25 May 1990) . Soil contamination remained undefined. <br /> 6. Several letters sent to Geweke between July 1991 and October 1991 failed <br />• to bring them into compliance. A Notice of Violation was issued to Geweke <br /> on 28 October 1991 for failure to submit quarterly reports and required <br /> submittal of a Final Remediation Plan (FRP) by 2 January 1992. <br />
