The following is an itemized list of hazardous materials violations that have not been addressed for SJC FAIRGROUNDS as of May 17, 2019. Open violations from May 09, 2017 inspection Violation #5 - Failed to complete and/or submit hazardous materials inventory for all reportable materials on site. Reportable amounts of methanol, car wash detergent, waste oil, waste diesel, acetone, propane and containers of unknown material were found on site that have not been reported. Any material that meets or exceeds the reportable quantity shall be reported in the facility's business plan. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and submit to the EHD for approval. Violation #6 - Failed to complete and/or submit a site map with all required content. The site maps do not show all of the hazardous material storage and handling locations and a legend/key to identify the codes used to denote hazardous material storage containers was not provided. A site map shall contain a north orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency response equipment. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. Violation #9 - Failed to annually review and certify that the business plan is complete, accurate, and up to date. The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually for 2015, 2016 and 2017. The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. Violation#10 - Failed to submit revisions to business plan within 30 days of substantial change in operations. During the inspection, Reportable amounts of methanol, car wash detergent, waste oil, waste diesel, acetone, propane and containers of unknown material were found on site and the updated information has not been submitted. Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): -A 100 percent or more increase in the quantity of a previously disclosed material. -Any handling of a previously undisclosed hazardous materials -A change of business address, business ownership, or business name. Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. Violation#11 - Failed to provide or document initial and/or refresher training to appropriate personnel. Employee training records were not available at the time of inspection. The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. Violation #12 - Failed to have the business plan readily available to facility or EHD personnel. Facility could not provide the Emergency Response Plan and the Chemical inventory upon request. The emergency response plans and procedures, the inventory of information required by this article, and the site map required by this section shall be readily available to personnel of the business or the unified program facility with responsibilities for emergency response or training pursuant to this section.
