The following is an itemized list of hazardous materials violations that have not been <br /> addressed for SJC FAIRGROUNDS as of May 17, 2019. <br /> Open violations from May 09, 2017 inspection <br /> Violation #5 - Failed to complete and/or submit hazardous materials inventory for all reportable materials on <br /> site. <br /> Reportable amounts of methanol, car wash detergent, waste oil, waste diesel, acetone, propane and containers of <br /> unknown material were found on site that have not been reported. Any material that meets or exceeds the <br /> reportable quantity shall be reported in the facility's business plan. Immediately log into the California Environmental <br /> Reporting System (CERS) at http://cers.calepa.ca.gov/, add the materials to the hazardous material inventory, and <br /> submit to the EHD for approval. <br /> Violation #6 - Failed to complete and/or submit a site map with all required content. <br /> The site maps do not show all of the hazardous material storage and handling locations and a legend/key to identify <br /> the codes used to denote hazardous material storage containers was not provided. A site map shall contain a north <br /> orientation, loading areas, internal roads, adjacent streets, storm and sewer drains, access and exit points, <br /> emergency shutoffs, evacuation staging areas, hazardous material handling and storage areas, and emergency <br /> response equipment. Immediately log into the California Environmental Reporting System (CERS) at <br /> http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br /> Violation #9 - Failed to annually review and certify that the business plan is complete, accurate, and up to <br /> date. <br /> The business plan information has not been reviewed and resubmitted in the California Environmental Reporting <br /> System (CERS) annually for 2015, 2016 and 2017. The hazardous materials inventory shall be submitted by <br /> January 15 of each calendar year and may be submitted beginning November 1 of the previous year. Immediately <br /> log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for <br /> approval. <br /> Violation#10 - Failed to submit revisions to business plan within 30 days of substantial change in <br /> operations. <br /> During the inspection, Reportable amounts of methanol, car wash detergent, waste oil, waste diesel, acetone, <br /> propane and containers of unknown material were found on site and the updated information has not been <br /> submitted. Within 30 days of one the following events, business shall electronically update the information <br /> submitted to the California Environmental Reporting System (CERS): <br /> -A 100 percent or more increase in the quantity of a previously disclosed material. <br /> -Any handling of a previously undisclosed hazardous materials <br /> -A change of business address, business ownership, or business name. <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the <br /> correct or updated information, and submit to the EHD for approval. <br /> Violation#11 - Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> Employee training records were not available at the time of inspection. The business plan shall include provisions <br /> for ensuring that appropriate personnel receive initial and annual refresher training. This training shall be <br /> documented electronically or by hard copy and shall be made available for a minimum of three years. Immediately <br /> provide employee training for appropriate personnel and submit a copy of the training records to the EHD. <br /> Violation #12 - Failed to have the business plan readily available to facility or EHD personnel. <br /> Facility could not provide the Emergency Response Plan and the Chemical inventory upon request. The emergency <br /> response plans and procedures, the inventory of information required by this article, and the site map required by <br /> this section shall be readily available to personnel of the business or the unified program facility with responsibilities <br /> for emergency response or training pursuant to this section. Immediately make arrangements to have the business <br /> plan readily available for review. <br /> Page 1 of 1 <br />
