The following is an itemized list of hazardous waste violations that have not been
addressed for SJC FAIRGROUNDS as of May 17, 2019.
Open violations from July 20, 2017 inspection
Violation#301 -Facility not maintained to minimize the release of a hazardous waste.
2 areas near the toilet storage building had dark oily staining in the dirt. During the business plan inspection,
inspector had taken photos of drums leaking in both of these areas. The drums have since been moved near the
horse stables, leaving contaminated dirt behind. Facilities shall be maintained and operated to minimize the
possibility of a fire, explosion, or release of hazardous waste to air, soil, or surface water which could threaten
human health or the environment. Immediately remove the impacted soil, and manage according to Title 22
hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was
managed.
Violation#601 -Stored hazardous waste onsite greater than 180 days.
At time of inspection:
1 55g drum of used oil had a start accumulation date of 2011.
Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste
stored on site at any time may store waste on site up to 180 days. Immediately contact a licensed hazardous waste
hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD.
Note: While it could not be determined what was in the other 30+ 55g drums or the hundreds of 5g buckets with
paint labels, if it is determined they are a hazardous waste they also must be removed immediately by a licensed
hazardous waste hauler.
Violation #608 - Failed to properly manage used oil and fuel filters.
Bills of lading for the recycling of used oil filters for the last three years were not found on site. A copy of each bill of
lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading for used oil filters
for the last three years, maintain them on site, and submit copies to the EHD.
Used oil filters were seen in the shop and outside near the horse stables in pans, open without a label. Used oil
filters shall be drained of free-flowing oil, stored in a closed, rainproof container, labeled as"drained used oil filters,"
and marked with an accumulation start date. Immediately have these filters removed either under a hazardous
manifest or a bill of lading (if punctured and recycled). Ensure proper storage for future used oil filter accumulation.
Violation #704- Failed to properly manage universal waste lamps.
UW lamps were found all over the property. Lamps were stored in trash cans, cardboard boxes, disintegrated
cardboard boxes outside, shrink-wrapped on pallets stored on racks several feet in the air. They were stored in the
maintenance shop, the overflow building, outside on pallets, outside in plastic trash containers and in the toilet
storage room. Multiple broken bulbs were seen. Due to safety issues and blocked access inspector could not get
an accurate count of the bulbs but it is estimated 800-1000 waste bulbs were identified on the property. Universal
waste lamps shall be stored in a manner that prevents breakage and release to the environment. All broken
universal waste lamps and releases shall be immediately cleaned and containerized. Immediately store all universal
waste lamps in a manner that prevents breakage and release to the environment.
Violation #706 - Failed to properly manage universal waste electronic devices, CRTs or CRT glass.
A printer and a computer modem were seen in a 20 yard roll off bin . Universal waste electronic devices, CRTs and
CRT glass shall be stored in a manner that prevents breakage and release to the environment. All broken universal
waste electronic devices, CRTs, and CRT glass and releases shall be immediately cleaned and containerized
Immediately remove the printer and computer modem from the trash and store all universal waste electronic
devices, CRTs, and CRT glass in a manner that prevents breakage and release to the environment
Page 2 of 3
