Additional work to more fully <br /> L assess the extent of PPCs in soil is not anticipated but could become necessary. <br /> ` The purpose of a geologic/hydrogeologic study is to reasonably characterize existing site <br /> j,. conditions based on the geology/hydrogeology of the area. In performing such a study, it <br /> is understood that a balance must be struck between a reasonable inquiry into the site <br /> Lconditions and an exhaustive analysis of each conceivable environmental characteristic. <br /> No investigation is thorough enough to describe all geologic/hydrogeologic conditions of <br /> L interest at a given site. If conditions are not identified during the study, such a finding <br /> should not be construed as a guarantee of the absence of such conditions at the site, but <br /> rather as the result of the services performed within the scope, limitations, and cost of the <br /> work performed. <br /> There are no third-party beneficiaries of this agreement between the client and Twining and <br /> L no third-party shall be entitled to rely upon any work performed or report prepared by <br /> Twining hereunder for any purpose whatsoever. The client shall indemnify and hold <br /> Twining harmless against any liability to any third-party for any loss, expense, or damage <br /> arising in connection with reliance by any such third-party on any work performed or reports <br /> issued by 'Twining. <br /> Twining's professional services will be performed, findings obtained, and conclusions <br /> prepared consistent with generally-accepted environmental assessment principles and <br /> practices in San Joaquin County at the time the work is performed.
