Williamson ~; -2- f 14 August 1985 and 25299.5 states = "This chapter shall not be construed to limit or abridge the powers and duties granted to the`-:State Department of Health Services by Chapter 6.5 (commencing with Section 25100) and- Chapter 6.8 (commencing with Section 25300) or to the State Water Resources Control Board and each regional . water quality control board by Division 7 (commencing with Section 13000) .of the Water Code." California Water Code Section 13267 states in part: "(a) A regional board, in establishing or reviewing any water quality control plan - or waste discharge requirements, or in connection with any action relating thereto or authorized by this division, may investigate the quality of any waters . of the state within its region. (b) In such an investigation, the regional board may require that any person discharging or proposing to discharge waste within its region or any citizen .or domiciliary, or political agency or entity of this state discharging or proposing to discharge waste . outside of its region that could affect the equality of waters within its region shall furnish, under penalty of perjury, such technical or monitoring program reports- as` the board may spec ify; provided;.that the burden, including costs, of: such reports:. shall bear a reasonable relationship to the need for; the report and the benefits- to be otained therefrom." .} Pursuant to our authority under the Water., Code .and Health and Safety Code we "request that-you perform the following: F 1. _ Monitor all ,on-site wells daily at all service ,stations:owned or. operated by Kayo where gasoline has been determined to have been.-released and -remove accumulated product found. 2. Obtain water samples from all ground water monitoring wells on Kayo's sites and have them analyzed. Samples are to be taken before 30 August 1985 and results reported to the Regional Board and Local Agencies no later than 20 days after the samples-- are taken. Analyses shall include: Total hydro- carbons, Benzene, Toluene, and Xylene, 3. Submit work plans to the :Regional Board and Local Agencies for review and approval . The work plans shall include: • installation of additional ground water monitoring wells 'to supplement .the three currently at each site; and service station inventory records for _gasoline and diesel fuels. The proposed wells must be sufficient to characterize the ..areal and vertical. extent of ground water and soil contamination '.(off-site wells may be required) and may require phased drilling. The work plan, due by::2 September 1985, is to include a time schedule for phasing and completing the work.
