The following is an itemized list of hazardous waste violations that have not been <br /> addressed for FERGUSON FARMS INC SITE 1 NORTH as of May 23, 2019. <br /> Open violations from April 26, 2017 inspection <br /> Violation #102 -Failed to determine if a waste is a hazardous waste. <br /> Oily absorbent(kitty litter) was observed in the shop area in a five gallon bucket. This waste stream is not being <br /> handled as hazardous waste. Any person who generates a waste shall determine if the waste is a hazardous <br /> waste. Immediately make a hazardous waste determination for the oily absorbent waste, and manage it according <br /> the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this <br /> waste was managed. <br /> Violation #104- No modified contingency plan. <br /> An emergency coordinator and modified contingency plan information is not posted at the facility. There must be at <br /> least one emergency coordinator on site or on call to coordinate emergency response measures, and the following <br /> information must be posted by a phone: the name and phone number of the emergency coordinator; location of fire <br /> extinguishers, spill control equipment, and if present, fire alarm; and the phone number of the fire department, <br /> unless the facility has a direct alarm. Immediately appoint an emergency coordinator and post the required <br /> information at the area where hazardous waste is being generated. A form is provided that can be used for this <br /> purpose. <br /> Violation#105 - No emergency coordinator. <br /> An emergency coordinator and modified contingency plan information is not posted at the facility. There must be at <br /> least one emergency coordinator on site or on call to coordinate emergency response measures, and the following <br /> information must be posted by a phone: the name and phone number of the emergency coordinator; location of fire <br /> extinguishers, spill control equipment, and if present, fire alarm; and the phone number of the fire department, <br /> unless the facility has a direct alarm. Immediately appoint an emergency coordinator and post the required <br /> information at the area where hazardous waste is being generated. A form is provided that can be used for this <br /> purpose. <br /> Violation #505 -Failed to completely label stationary hazardous waste tanks. <br /> The facility has a 500 gallon used oil tank in the"south" area . The tank is labeled "used oil" only. All hazardous <br /> waste tanks shall be marked with the words "Hazardous Waste" and the accumulation start date. Immediately <br /> ensure that all hazardous waste tanks are marked with the required information. <br /> Violation#601 -Stored hazardous waste onsite greater than 180 days. <br /> Facilities who generate less than 1000 kg of hazardous waste per month and do not exceed 6000 kg of waste <br /> stored on site at any time may store waste on site up to 180 days. The"south" used oil tank was missing an <br /> accumulation start date. Since it cannot be determined how long the hazardous waste has been on site, <br /> immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest. Submit a copy of <br /> the manifest to the EHD within 30 days. <br /> Violation #608 - Failed to properly manage used oil and fuel filters. <br /> Oil filters were stored in open and unlabeled containers . Used oil filters shall be drained of free-flowing oil, stored in <br /> a closed, rainproof container, labeled as"drained used oil filters," and marked with an accumulation start date. <br /> Immediately label and securely close the filter drums and ensure that all used oil filters are managed in this way. <br /> Properly dispose of the filters within one year of generation and keep the recycling records for three years. <br /> Page 1 of 1 <br />
