Page 3, 1645 Cherokee <br /> As discussed in SJC/EHD correspondence dated September 12, 2005, the excavation <br /> went beyond that which was proposed for remediation of the contamination resulting <br /> from the UST's. The Report did not document or discuss the domestic well that was <br /> discovered on the east side of the excavation and subsequently destroyed under <br /> SJC/EHD permit and inspection, or the other debris and pockets of contamination <br /> discovered during the course of the work. In the September 12, 2005 correspondence <br /> SJC/EHD referred you to the Regional Water Quality Control Program—SLIC (spills, <br /> leaks, investigations and cleanup) unit. It very difficult to effectively evaluate how <br /> much of the contaminated soil removed was related to the former UST's with the <br /> information, maps and data tables provided in the Report. <br /> The Report recommends SJC/EHD "issue a Notice of No Further Action for the soil <br /> contamination"associated with the former UST's at this site. SJC/EHD does not issue <br /> partial "No Further Action" (NFA) notices. As you were informed in correspondence <br /> dated May 20, 1999, a Remedial Action Completion letter will be provided after <br /> SJC/EHD has determined that no further investigation or remedial action is required at <br /> this site. The impact of the interim remedial action of the excavation of contaminated <br /> soils on the documented groundwater at this site has not been evaluated. As proposed <br /> in the RAWP, groundwater monitoring wells must be re-installed at this site. Please <br /> proceed with submittal of a work plan to reinstall groundwater monitoring.wells and to <br /> continue the investigation of the vertical and lateral extent of the documented <br /> groundwater contamination at this site. The work plan is due for submittal to SJC/EHD <br /> no later than July 6, 2007. <br /> Per California Code of Regulations, Title 23, Chapter 30, section 3890 all contaminated <br /> UST sites must electronically transmit to Geotracker, the State Water Resource Control <br /> Board database website, reports of work performed, laboratory data from chemical <br /> analysis of samples, well elevation survey data, site maps and measured quarterly <br /> groundwater depth measurements. Reports from your site have not been submitted to <br /> Geotracker.
