Box 8068
Stockton, CA 95208
Attention: Mary Raygoza
PROPOSED CLEANUP AND ABATEMENT --'RDER, DELTA TRUCK SALES, SAN
JOAQUIN COUNTY
As we discussed on 23 March 1990 during a f forinspection,
ct on, we are
preparing a Cleanup and Abatement Order (C&A) Y our
signed b
The 3 January 1989 Notice of Violation (NOV) g
Executive Officer required corrective actions for compliance with
the Toxic Pits Cleanup Act (TPCA) . Staff notes that in response .
to the NOV the surface impoundment has been partially excavated and
that approximately 5, 000 yards of waste soil have been stockpiled
on site awaiting proper sampling, waste characterization,
remediation and/or disposal. The environmental
assessment of
subsoils and ground water beneath the toxic pit, the ceasing the
discharge (storage) of hazardous waste, and the closure of the pit
are items still Out of compliance with the TPCA and have not been
addressed since our January 1989 NOV.
Also no substantial progress toward completion of a Hydrogeological
Assessment Report (HAIR) , Section 25208.8 Health and Safety Code,
has been accomplished. The proposed C&A will contain a time
schedule with specific tasks and dates for completion of the TPCA
requirements. A projected HAR completion date of 1 September 190
was discussed and tentatively agreed upon. To help y your
consultant through the closure process and the completion of the
HAR, we are amenable- to breaking down the process into smaller
tasks or phases. Initially, we feel that a reasonable
environmental assessment would include the installation of ground
water wells and a subsoil investigation of potential contamination.
The first phase (Phase 1) towards the completion of the HAR shall
consist of, but is not limited to 1) the characterization of the
remaining waste within the surface impoundment, 2) the installation
of ground water monitoring wells to determine water quality and
gradient, and 3) sampling beneath the surface impoundment to
characterize the lateral and vertical extent of potential migration
of waste residues from the surface impoundment through the va.dose
zone and into shallow ground water. With these items you will be
able to determine what further steps are necessary to ccmplete the
