Corrective Action: Please include the 95 Percent design document or explain what is <br /> reviewed in the "95% review." <br /> 6. Summary of Considerations <br /> The attached text "Summary of Considerations DDRW-Tracy OU-1" references data <br /> gaps "which could not be satisfied earlier due to easement and land purchase <br /> complications." It should be noted that DDRW-Tracy has the authority under <br /> CERCLA Section 104 to access private property where contamination may have <br /> migrated (refer to EPA letter dated October 19, 1992, from Michael Work, EPA, to <br /> Marshall Cloud, DDRW-Tracy). <br /> Corrective Action: As has already been discussed with DDRW-Tracy, although the <br /> facility has decided to purchase the land to the north and northeast, EPA recommends <br /> that the facility concurrently pursue the legal options available to obtain the access <br /> necessary to fill the identified data gaps. <br /> EPA September 20, 1993 4/4 <br />
