This letter documents our response to information received from EPA on 8 July 1993 and to <br /> questions raised in a conference call between the Regional Board, EPA, and DDRW, Tracy on 20 <br /> July 1993. Due to the expediency needed to complete the Final OU-1 ROD, a negotiated agreement <br /> was reached in a conference call on 9 August 1993 between all parties that would allow the OU-1 <br /> ROD to be finalized. As stated in the OU-1 ROD, the issue of whether Division 3, Chapter 15 of <br /> Title 23 of the California Code of Regulations is an ARAR has not been finally resolved. This issue <br /> must be resolved to avoid disputes on future RODS. <br /> ARARs to be deleted or amended <br /> The Regional Board believes that the following sections should be deleted from the ARARs tables <br /> for DDRW, Tracy: <br /> National Secondary Drinking Water Standards <br /> Toxic Pollutant Effluent Standards <br /> Clean Water Act <br /> Inland Surface Waters Plan <br /> In addition, the Regional Board would like the Comments section for State Water Resources Control <br /> Board Antidegradation Policy to be amended to read: <br /> "The RWQCB establishes effluent treatment standards for groundwater based upon this <br /> policy. DDRW-Tracy will apply best practicable treatment or method of control for OU-1 <br /> remediation. Effluent treatment standards for this action are identified in Table 4.2-3." <br />
