Box 960001 <br /> Stockton, CA 95296-0250 <br /> RE: CERCLA Section 120(e)(2) and the DDRW-Tracy OU-1 Remedial Design Schedule <br /> Dear Mr. Mcllvoy: <br /> Thank you for your letter of May 27, 1993, in which you request that EPA consider <br /> whether the forthcoming expansion and operation of the IRM at DDRW-Tracy would be <br /> sufficient to meet the requirements of CERCLA §120(e)(2). This section states that <br /> "substantial continuous physical onsite remedial action shall be commenced at each facility <br /> not later than 15 months after completion of the investigation and study." It is EPA's <br /> understanding that DDRW-Tracy wishes clarification on this matter prior to development and <br /> submission of the draft remedial design and remedial action (RD/RA) schedule for OU-1. <br /> [Note: The RD/RA schedule is due September 3, 1993, i.e., 21 days following finalization of <br /> the OU-1 ROD.] <br /> DDRW-Tracy may find it instructive to review the RD/RA schedule developed for OU-1 <br /> for the DDRW-Sharpe facility (attached) as an example for developing the RD/RA schedule for <br /> OU-1 at DDRW-Tracy. It is noteworthy that the schedule for OU-1 at DDRW-Sharpe <br /> demonstrates compliance with the CERCLA 120(e)(2) 15-month deadline and that the DDRW- <br /> Sharpe schedule was developed with an IRM pump-and-treat system in place and operating. <br /> EPA encourages DDRW-Tracy to develop an OU-1 RD/RA schedule which will provide <br /> for full-scale remedial action as expeditiously as practicable.
