Reference: Joe/Peter Alvarez letter, April 2 , 1993, subject: <br /> Property North of Tracy Defense Depot. <br /> 2 . The Defense Distribution Reqion West, Environmental Protection <br /> Division (DDRW-BE) , has reviewed the referenced letter. As was <br /> explained during the public meeting (held January 14 , 1993, which <br /> he references in his letter) , DDRW is paying for right-of-ways to <br /> Mr. Alvarez ' s neighbor because DDRW needs access to that property <br /> in order to perform/complete its ground water investigation. <br /> 3 . Mr. Alvarez makes the statement that approximately one-third <br /> of his property ( 53 acres ) is contaminated based on information <br /> presented during the DDRW Tracy public meeting. What was <br /> explained to Mr. Alvarez was that ground water flowing under a <br /> portion of his property is contaminated with tetrachloroethene <br /> (PCE ) and trichloroethene (TCE ) , solvents , for which DDRW Tracy is <br /> responsible. It was also explained to Mr. Alvarez that we (DDRW) <br /> did not intend to contract with him for any right-of-ways since <br /> access to his property was not necessary to DDRW Tracy for the <br /> performance of its ground water investigation. <br /> t <br /> 4 . The ground water contamination under the surface of <br /> Mr. Alvarez ' s property has in no way prevented him from pursuing <br /> his livelihood of farming this property. Mr. Alvarez uses surface <br /> water obtained from the West Side Irrigation District for the <br /> irrigation of his crops . <br /> 5 . As Mr. Alvarez stated in his letter, he did speak to DDRW's <br /> Counsel (Mr. David Riley) during the public meeting. Mr. Riley <br /> advised Mr. Alvarez that he would be happy to provide the <br /> information necessary for Mr. Alvarez to file a claim against the <br /> Federal government for any tort claim he feels he has suffered as <br /> a result of the contamination. To date, Mr. Alvarez has not <br /> requested these forms nor has he exercised his right to file a <br /> claim against the government . Once a claim is filed, it will be <br /> forwarded to the cognizant agency for tort claims adjudication, <br /> the Army Claims Service. <br />
