NO CA491520834 <br /> The Department of Health Services (DHS) , Toxic Substances Control <br /> Division and the Environmental Protection Agency - Region IX, <br /> have completed their review of the Closure Plan for two <br /> underground storage tanks. One tank is located at Building 247 <br /> and the other tank is located at Warehouse 28. The initial <br /> review of the Closure Plan resulted in the issuance by DHS of a <br /> Notice of Deficiency, dated April 23 , 1987 . DHS has also been in <br /> telephone contact with DDTC concerning modifications to the <br /> Closure Plan. In response to the Notice of Deficiency and <br /> telephone conversations, DDTC submitted a revised Closure Plan <br /> dated May 20, 1987 . <br /> DHS has determined that the tank at Building 247 must close under <br /> both RCRA regulations (40 CFR Part 264) and DHS regulations <br /> (Title 22, California Administrative Code (CAC). DDTC has, in a <br /> letter dated July 2, 1987 , informed DHS that the second tank, <br /> which is located at Warehouse 28 , was emptied, rinsed and filled <br /> with sand prior to November, 1979. At this time DDTC wishes to <br /> remove the tank from the ground and dispose of it. Because this <br /> tank was removed from service prior to November 19, 1980, it is <br /> not subject to RCRA regulations. However, this tank will be <br /> closed under CAC Title 22 . <br /> The regulatory agencies have determined that the Closure Plan has <br /> adequately addressed all of the issues needed to insure the <br /> proper closure of this unit. The Closure Plan calls for removal <br /> of the tanks, all hazardous waste, and all hazardous waste <br /> residues that might have escaped from the units to the adjacent <br /> or underlying soil. This closure Plan takes into account all of <br /> the regulatory and technical requirement needed to insure <br /> protection of human health and the environment during and after <br /> the closure activities. <br />
