GROUNDWATER OPERABLE UNIT, <br /> DEFENSE DISTRIBUTION DEPOT SAN JOAQUIN TRACY SITE, SAN JOAQUIN COUNTY <br /> Central Valley Regional Water Quality Control Board (Central Valley Water Board) staff has <br /> reviewed the April 2011 draft final Record of Decision Remedy for Northwestern Corner <br /> Groundwater Operable Unit (Draft Final ROD). URS Corporation prepared the Draft Final <br /> ROD on behalf of Defense Logistics Agency Enterprise Support San Joaquin, California (DLA) <br /> for the Defense Distribution Depot San Joaquin, Tracy facility. Pursuant to the Tracy Federal <br /> Facilities Agreement (FFA), Section 12, Dispute Resolution, the Central Valley Water Board <br /> invokes informal dispute resolution with regards to the Draft Final ROD. <br /> The Central Valley Water Board received the Draft Final ROD on 26 April 2011 . Pursuant to <br /> the approved schedule under the FFA, the document would become final on 26 May 2011, had <br /> no significant issues been identified. However, as discussed with DLA on several occasions, <br /> Central Valley Water Board staff has outstanding concerns with the Draft Final ROD. Although <br /> the parties have begun discussions, these concerns have not been resolved, and therefore <br /> Central Valley Water Board is invoking the dispute resolution process to prevent the Draft Final <br /> ROD from becoming final, and is requesting an extension of the deadline to <br /> 26 June 2011 to finalize the Draft Final ROD. <br /> Pursuant to Section 12.2 of the Tracy FFA, "[pjrior to any Party's issuance of a written <br /> statement of a dispute, the disputing Party shall engage the other Party in informal dispute <br /> resolution among the Remedial Project Managers and/or their immediate supervisors. During <br /> this informal dispute resolution period the Parties shall meet as many times as are necessary <br /> to discuss and attempt resolution of the dispute." In order to conduct at least one informal <br /> dispute resolution meeting between staff and managers of the DLA, the Central Valley Water <br /> Board, the California Department of Toxic Substances Control (DTSC), and the United States <br /> Environmental Protection Agency (U.S. EPA), Central Valley Water Board staff requests that <br /> the informal dispute resolution process continue on the Draft Final ROD until 26 June 2011. <br /> Pursuant to Section 12.9, the invocation of the dispute resolution process extends the deadline <br /> for the disputed work for a period of time usually not to exceed the time taken to resolve the <br /> California Environmental Protection Agency <br /> �aRecycled Paper <br />
