Box 960001 <br /> Stockton, CA 95296 <br /> RE: DDJC-Tracy,Proposed FFA Schedule of July 22,2003 <br /> Dear Marshall, <br /> Thank you for the opportunity to review the newly proposed Federal Facility Agreement(FFA) <br /> schedule dated July 22, 2003. Per the terms of the FFA we are commenting within seven days. <br /> Remedial Action Reports (RARs) for multiple actions are dependent upon the finalization of the <br /> proposed draft Explanation of Significant Differences(ESD) and the draft final Record of Decision <br /> (ROD)Amendment. EPA is interested in pursuing an expedited schedule for these documents and we <br /> recommend a conference call as soon as possible to explore our options. Finalizing the ROD <br /> Amendment and the ESD earlier will allow the following RARs to move forward more expeditiously, <br /> i.e., the RAR for SWMUs 4, 6 and 20, the RAR for DSERTS 67 (north depot area), and the RAR for <br /> SWMU 8. Please note our specific comments below: <br /> the ROD Amendment, already a draft final document, has a proposed submission date of <br /> September 30 2003. Proposed text on Institutional Controls (ICs)has already been provided by <br /> our office. We question why an additional two months is needed for re-submission of the draft <br /> final document. <br /> — also regarding the ROD Amendment, we note that the schedule indicates an additional comment <br /> period after the submission of the draft final (September 30,2003 to October 30, 2003,reference <br /> footnote `c')with a finalization date of January 5 2004. EPA was under the impression that DLA <br /> did not believe an additional public review wag necessary for this document. <br /> — we note that the schedule for the ROD Amendment provides the usual 60 days for the regulatory <br /> review. EPA is willing to commit to a shorter review time frame if the only difference in this <br /> document is the addition of the IC text. <br />
