(AGE) has prepared a response to the EHD letter dated 19 <br /> December 201 1 for the directive to prepare a ground water feasibility study for the southern <br /> underground storage tank (UST) at 639 West Clay Street, Stockton, California. <br /> West Clay Property notified by the Underground Storage Tank (UST) Cleanup Fund that <br /> future reimbursements and claim authoritywould be assigned to the current propertyowner <br /> KRC. <br /> Due to the costs of monitoring activities at the site, KRC has accrued over $40,000 of <br /> monitoring expenses that have not been reimbursed by the UST Cleanup Fund. The <br /> accrued cost for the ground water monitoring has caused a great financial hardship on <br /> KRC property which now owns the site. Furthermore, based on the current conditions at <br /> the state, it is unlikely that KRC will receive any type of reimbursement from the UST <br /> Cleanup Fund before late 2012, as the claim assignment process is not completed or time <br /> line has not been determined by the USTCF. KRC does not have the financial capabilities <br /> to continue evaluation of remediation which will not have potential for USTCF <br /> reimbursment; or to installed wells which do not directly benefit the ground water plume <br /> remediation nor perform ground water monitoring activities at the site, until KRC can <br /> receive reimbursement from the UST Cleanup Fund (i.e. $ 40,000 or more). <br /> K,3:- :,::,J.
