Commerce Street <br /> Stockton, CA <br /> On November 4, 1994, San Joaquin County Public Health Services, Environmental <br /> Health Division (PHS/EHD) received a complaint that a stockpile of contaminated <br /> soil was being removed from 1111 N. Union Street, Stockton. The investigation <br /> as to the original source of the soil being removed raised several questions. <br /> This letter is to summarize the items discussed at a meeting held on November 15, <br /> 1994 at PHS/EHD regarding the soil that was removed from 1111 N. Union Street. <br /> The following people attended the meeting: <br /> David Irey San Joaquin County Deputy District Attorney <br /> Diane Hinson PHS/EHD <br /> Margaret Lagorio PHS/EHD <br /> Ron Bloom Charles Bloom Construction <br /> Fred Clarke Property owner <br /> Mary Clarke Property owner <br /> John Cummings John Cummings & Associates <br /> In April and May 1993 petroleum hydrocarbon contaminated soil was excavated from <br /> a former underground storage tank area at 729 S. Commerce, Stockton and <br /> stockpiled on site. On May 25, 1993, the excavated soil was being removed from <br /> that site by Falcon Energy. PHS/EHD issued Jim Hoblitzell from Falcon Energy a <br /> notice to cease transport of the soil off site until proper testing of the soil <br /> had been completed and an appropriate disposal facility identified. In addition, <br /> Mr Hoblitzell was instructed to return to the site any soil that had already been <br /> removed. On May 26, 1993 the excavation was filled with clean material and the <br /> contaminated soil was stockpiled on site. <br /> PHS/EHD has not received a report of the above excavation activities to date. <br /> The report is to be signed by a Registered Geologist, Certified Engineering <br /> Geologist, or Registered Engineer per Appendix A - Reports, Tri-Regional Board <br /> Staff Recommendations August 30, 1991 (copy enclosed) . All future work and <br /> reports which require geologic or engineering evaluations such as monitoring well <br /> installations must be performed under the direction of an appropriately <br /> registered or certified professional (See sections 6735, 7835, and 7835.1 of the <br /> Business and Professions Code) . <br /> On August 30, 1993, PHS/EHD received a letter from John Cummings dated August 24, <br /> 1993, stating that the stockpile at 729 S. Commerce had been sampled and the <br /> results of the soil sample analysis indicated the soil to be not hazardous. In <br /> the letter Mr. Cummings requested permission to transport the soil from 729 S. <br /> Commerce to 1111 N. Union. The soil was to remain covered until an aeration <br /> permit had been obtained. <br /> On September 2, 1993, Margaret Lagorio called John Cummings and informed him that <br /> the soil could be moved and to notify PHS/EHD prior to any soil sampling in the <br /> A Division of San Joaquin County Health Care Services <br />
