Commerce <br /> Stockton, CA <br /> San Joaquin County Pubic Health Services,Environmental Health Division (PHS/EHD)has <br /> reviewed the letter from Falcon Energy Associates dated May 29, 1993 concerning the <br /> stockpiled soil at the above referenced site. <br /> Although there is continuing discussion concerning the classification of petroleum <br /> contaminated soil PHS/EHD requires that this type soil be certified non-hazardous according <br /> to the requirements of the California Code of Regulations Title 22 Division 4.5 Article 3 <br /> Section 66261.2 prior to off-site transport. Specifically pursuant to guidance provided <br /> PHS/EHD from California EPA, Department of Toxic Substance Control in 1989 <br /> responsible parties should conduct self certification by performing bioassay testing and waste <br /> extraction testing for metals. These tests are also required by landfills prior to their <br /> acceptance of petroleum contaminated soils. Until some other guidance is provided by the <br /> state agencies PHS/EHD will continue to require the bioassay and metal testing of <br /> petroleum contaminated soil prior to transport. <br /> The samples collected from this site on April 16, 1993 were from the sidewalls and bottom <br /> of the excavation not the stockpiled soil. The samples were analyzed for BTEX, TPH-gas, <br /> TPH-diesel and lead. No other metals were analyzed for nor was the bioassay test <br /> performed. Thus certification of the soil as non-hazardous was not completed. <br /> Please notify PHS/EHD of your plans prior to the disposal or treatment of the stockpiled <br /> soil.
