Trucking and that 1Lar_2 tons of crushed rock was impbveted to backfill the <br /> excavation. An application was made to APCD and a permit issued for soil <br /> aeration. In reviewing these documents, a mistake was made on the application <br /> for soil aeration wherein approximately 450 tons is indicated as the quantity <br /> for aeration. From memory, I believe this was the quantity which had originally <br /> been estimated prior to completion of the excavation and was in one of the <br /> early field reports utilized to prepare the APCD application. A phone inquiry <br /> to the ex Falcon heavy equipment operator confirmed that he loaded a total of <br /> approximately fifty (50) loads during the two days the two trucks were moving <br /> soil from Commerce to Union Street. After completion of movement of the soil <br /> to Union Street, it was covered until the aeration permit was received. <br /> After aeration, Dr. John P. Cummings was independently retained by you <br /> to sample the stockpile for results of the aeration in February, 1994. Dr. <br /> Cummings reported that all results were non detectable and that the soil <br /> aeration had been successfully completed. The final soil sampling results <br /> are proof that the aeration was sucessfully completed. I am not privy to <br /> any of Falcons files and unable to supply any aeration records. I am aware <br /> that the soil was aerated over an approximate six month period. I very much <br /> regret the frustration and anxiety which you have experienced as a result <br /> of overzealous and uniformed bureaucrats. It is certainly the reason why I <br /> am currently making plans to relocate outside California. Thankyou very much <br /> for your past considerations and opportunities you provided.
