Cummings and Associates (JPCA) has been retained by Mr. <br /> Fred Clark as his Environmental Consultant for the subject site. <br /> After a review of the files, JPCA ascertained that two Fuel <br /> Underground Storage Tanks (UST) were removed from this site and <br /> that approximately 1000 tons of gasoline contaminated soil was <br /> excavated and remains on site. <br /> JPCA intends to apply for a permit to aerate the soil which is an <br /> acceptable practice under the regulations of the San Joaquin Valley <br /> Unified Air Basin District (SJVAPCD) . A preliminary inquiry to the <br /> SJVAPCD suggested that they would accept this proposal. There is, <br /> however, a unique situation regarding this site. As you are aware, <br /> the rear yard area from where the soil was excavated is very small <br /> and Mr. Clark is an elderly individual who is dependant on the <br /> income from his properties for his day to day survival. Both the <br /> tenants at this site are unable to carry out their business <br /> functions with the soil taking up so much space on the site. The <br /> two tenants are threatening to vacate the premises which would <br /> place Mr. Clark in great financial jeopardy. . <br /> Mr. Clark has another property at 1111 N. Union Street in Stockton <br /> which was occupied by Accent Paper Co. Accent has moved out and <br /> the property is presently vacant. The loss, caused by Accent's <br /> vacating the Union Street property, has exacerbated Mr Clark's <br /> financial problems. The Union Street property is large and has a <br /> large asphalt covered area which would be ideal to aerate the soil <br /> from the Commerce Street site. The Union Street site is a short <br /> distance from the Commerce Street site. In our initial discussion <br /> with the SJVAPCD, JPCA inquired as to the possibility of <br /> transporting the soil, which is not hazardous, to the Union Street <br />
