PUBLIC HEALTH SERVWtS
SAN JOAQUIN COUNTY r
ENVIRONMENTAL HEALTH DIVISION
Karen Furst, M.D., M.P.H., Health Officer
304 East Weber Avenue, Third Floor • Stockton, CA 95202
209/468-3420
TO: DAVID IREY, DEPUTY DISTRICT ATTORNEY
SAN JOAQUIN COUNTY DISTRICT ATTORNEY'S OFFICE /
ENVIRONMENTAL PROSECUTIONS UNIT
FROM: DONNA RERAN, R.E.H.S., DIRECTOR'
ENVIRONMENTAL HEALTH DIVISION
DATE: AUGUST 4, 1999
RE: REQUEST FOR LEGAL ACTION
FORMER COUNTRYSIDE MARKET
10848 COPPEROPOLIS RD
STOCKTON CA 95215
I. CASE SUMMARY
Two Underground Storage Tanks(UST's) were removed from this site on March 5, 1993.
Analytical results of the soil samples collected from beneath the UST's at about 7.5 feet below
surface grade(bsg)evidenced petroleum hydrocarbon contamination. In October 1995 the area
of the former UST's was excavated to I 1 feet bsg, a soil sample was collected at 13 feet bsg, and
the level of contamination in the soil sample collected was increased. Since that date
Environmental Health staff have directed the responsible parties to submit a work plan to
investigate the lateral and vertical extent of the petroleum hydrocarbon contamination and
encouraged them to cooperate in obtaining reimbursement for their corrective action costs from
the Cleanup Fund. The responsible parties have not complied with the directives.
Since Janet Wisecarver was the last owner/operator of the UST's, she is the only one who
qualifies for Cleanup Funds. She is not willing to supply the information requested by the
Cleanup fund to be eligible for corrective action reimbursement monies. Wisecarver has been
described by Poelstra and other involved parties as elderly and does not wish to be bothered. The
site is not in compliance with PHS/EHD directives for submittal of a Work Plan to determine the
lateral and vertical extent of contamination at this site.
II.
