(ATC). <br /> The Work Plan was submitted in response to my 10 June 2008 letter. The Work Plan includes <br /> a proposal to conduct a limited sensitive receptor survey (within a 500 foot radius of the site), <br /> sample all domestic wells found within said 500 foot radius, unless access is denied by <br /> individual well owners, advance three (3) soil borings, geologically log all borings, and collect <br /> and analyze soil and groundwater samples from each boring. <br /> The work is reasonable and approved with the following comments. ATC indicates that they <br /> will be using EPA Method 8020 to analyze for BTEX compounds and EPA Method 8260B to <br /> analyze for fuel oxygenates and additives. You may to use EPA Method 8260B for both, <br /> unless it can shown to be cost effective to run the additional sample analysis, in that Method <br /> 8260B also does the BTEX compounds, and the lab used may not charge extra. Further, soil <br /> samples are to be collected for analysis at all lithologic changes and possible impacted areas <br /> as determined by field screening of samples and cuttings, and at depths where previous <br /> contamination was identified during the earlier investigations and excavation. The report of <br /> results of the approved work is to be submitted by 31 March 2009.' <br /> Further, Regional Board staff is evaluating the file and seeking advice from our legal counsel <br /> to determine the ability to name Mr. Henry as the Primary Responsible Party, with Mr. Hodge <br /> and Mr. McArthur as Secondary Responsible Parties. This action is being evaluated due to <br /> Mr. Henry's past actions and site ownership, and that he may not have totally disclosed the <br /> severity of the contamination and requirements by the regulatory authorities to continue <br /> investigation and, as necessary, cleanup of the impacts of the contamination to the current <br /> property owner. <br /> CaliforniaEnvironmental Protection Agency <br /> 0 Recycled Paper <br />
