or damages arising out of the terms of this Agreement, but only in proportion to and to <br /> the extent such liability, loss, expense, attorneys' fees, or claims for injury or damages <br /> are caused by or result from the negligent or intentional acts or omissions of LLNL, its <br /> officers, agents, employees, or authorized contractors and subcontractors. The <br /> foregoing hold harmless agreement is limited with respect to LLNL to its self-insurance <br /> program. LLNL will issue and deliver a Certificate of Insurance in the amount of <br /> $1,000,000 to Owner naming Owner as an additional insured. LLNL's authorized <br /> consulting subcontractors conducting work on the TTF must also, as a condition of <br /> work, maintain liability coverage in the amount of$1,000,000. <br /> (2) LLNL is aware of the fact that the TTF is an explosives test facility. LLNL is <br /> fully cognizant of the potential for interference between the TTF's primary use and <br /> LLNL's entry as hereby authorized. By its signature to this Agreement, LLNL agrees to <br /> minimize its presence and impact upon the TTF and defer to Owner's operational <br /> considerations. <br /> (3) The monitor wells will be constructed in accordance with relevant San <br /> Joaquin County local health district regulations and standards and will be maintained <br /> at all times in accordance therewith. LLNL will apply for and satisfy all permit <br /> requirements. Each wellhead will be completed as a 12-inch diameter stovepipe. <br /> Dependent on maximum sustainable yield, either permanent submersible pump <br /> equipment will be installed in the wells or they will be bailed to collect water samples. <br /> In either event, no ground water will be discharged at the TTF. Copies of all well logs, <br /> permits, and test results from the monitor wells will be sent to Owner's representative, <br /> Douglas Mumma. <br /> (4) When the wells are deemed no longer necessary for monitoring or ancillary <br /> hydrogeologic purposes, Owner may request and accept full ownership and control of <br /> the wells on terms agreed to at that time in a Release document. Alternatively, at <br /> Owner's direction, the wells will be sealeci and abandoned in accordance with state and <br /> local requirements. <br /> 2 <br />
