NOTICE of FINAL PERMIT DECISION <br /> under SEP 17 11'"0 <br /> Resource Conservation and Recovery Act HECALTH <br /> Pr-RN1,11IT/SERVICES <br /> In accordance with the requirements of 40 CFR § 124.15, we are providing you <br /> with a notice of our decision to deny a final RCRA hazardous Waste permit for the <br /> following facility: Lawrence Livermore National Laboratory <br /> 7000 East Avenue, Livermore, California 94550 <br /> Operator: University of California <br /> Owner: U.S. Department of Energy <br /> Affected Unit: Existing Incinerator located in Bldg. 624 <br /> EPA Identification No. CA2 890 012 584 <br /> Between October 3, 1989 and December 18, 1989, Region IX of the U.S. <br /> Environmental Protection Agency (EPA) requested public comment on their intent <br /> to deny a Resource Conservation and Recovery Act (RCRA) permit application for a <br /> hazardous waste incinerator and treatment and storage facility owned by the U. S. <br /> Department of Energy and operated by University of California. The facility is <br /> located at 7000 East Avenue, Livermore, California. It is used to store and treat <br /> liquid and solid hazardous waste streams resulting from the Laboratory's <br /> operations. <br /> The incinerator was installed in 1980, and has been operating since then until <br /> early 1989 with RCRA interim status. The agency is hereby denying the final <br /> hazardous waste permit for the incinerator because the owner/operator has not <br /> provided a complete application that demonstrates compliance with the regulations, <br /> and in fact, announced the withdrawal of its permit application for that portion of <br /> its hazardous waste facilities. Upon the effective date of this denial, interim status is <br /> terminated for the incinerator, per 40 CFR §270.10(e)(5), and the facility will be <br /> required to cease the incineration of hazardous waste and mixed waste. The closure <br /> plan for this unit has been reviewed and given public review from June 27, 1990 to <br /> July 30, 1990. Finalization of the closure plan approval is expected to follow this <br /> act-,LOA-L soon. <br /> EPAaction on other portions of the proposed permit denial is deferred <br /> pending review of the extensive materials submitted by the Department of Energy <br /> and University of California (LLNL), and all other public comments concerning <br /> these facilities received during the public comment period. <br /> The final decision to deny the incinerator portion of the permit application <br /> becomes effective on October 15, 1990. This action constitutes a final permit decision <br /> under Title 40, Code of Federal Regulations, Section 124.15. <br /> The decision may be appealed in accordance with 40 C.F.R. Part 124. Anyone <br /> who filed comments on the draft decision or who spoke at the public hearing on the <br /> decision may file an appeal. Appeals to this decision must be filed within thirty (30) <br /> calendar days of the date of permit denial and should be directed to the Office of the <br /> Administrator, Environmental Protection Agency, Room 1145 - WT (A-101), 401 M <br />
