Williams <br /> San Joaquin Local Health District <br /> 1601 East Hazelton <br /> Stockton, California <br /> Re: Fees for Environmental Health <br /> Services Charged to Public Agencies <br /> Dear Dr. Williams : <br /> I am writing in response to your letter of September 26, <br /> 1979, in regard to the above. <br /> After reviewing the authorities , it is our opinion that <br /> Goveriiment'G6di "§6'T-0 "" g-ttA-e-h d7-Hereto �--.-._--_ <br /> � �'generally exempts public <br /> officers or bodies from the payment of fees for the performance <br /> of official services such as those performed under the Health <br /> District 's Environmental Health Permit and Service Charge system. <br /> There are, however, Tiuraler6u-8 except-loiis ito the general <br /> exemption of § 6103 which should be noted. The only exceptions , <br /> however, which would appear to be applicable to the current <br /> Environmental Health Permit Fee and Service Charge system is the <br /> one defined in Government Code §6103 . 11 as follows : <br /> "Section 6103 does not apply to any fee or <br /> charge for official services required by <br /> Title 7.3 (commencing with Section 66700") <br /> Government Code §6103 . 11 <br /> The services referred to in section 6103 . 11 concern service <br /> charges under the gement -and Resources Recovery <br /> Act. We would conclude that in the case of any services per- <br /> formed by the Health District for public Agencies under §66796.20 <br /> of the Government code, charges may be collected in the category <br /> -1 - <br />
